Atascadero, CA

At its October 8 meeting, Atascadero City Council began exploring a new short-term rental ordinance. The council is considering things such as zoning standards, STR applications, annual property reviews, vendor tax collection, and monitoring, whether a property should be owner-occupied, and how to address existing rentals. The topic will be brought back for further discussion.

Currently, Atascadero issues a “Home Occupation Business License” which is only allowed to be one per property. Further, only 40% of units in a commercial mixed-used project can become short term rentals unless it’s used as a hotel.

Last October 22, Denton City Council approved new restrictions on short-term rentals, capping the total number at 1,000, a maximum of two certificates per parcel, and a requirement of a 100-foot separation between properties.

Nonresidential areas and mixed-use neighborhoods are exempt from these limits. In multifamily developments, up to 10% of units can operate as short-term rentals. All rentals must register with the city and pay hotel occupancy taxes. The registration period is one year, from Jan. 1 until Dec. 31. Properties registered by Jan. 1 will be allowed to be grandfathered in under the new rules. Violations can lead to the revocation of rental certificates. Read more about the ordinance below.

Walter's goal is to allow local governments to better manage short-term rentals that operate illegally, without imposing new mandates.

This legislative effort follows a report showing Utah’s short-term rental market has grown rapidly, with over 23,000 monthly listings in 2023, up 39.4% from 2021. Though they currently make up only 1.9% of the state’s housing stock, the rising numbers highlight the need for better oversight, according to experts.
