New Mexico

New Mexico lawmakers are weighing whether to standardize how counties classify short-term rentals after a legislative report highlights inconsistent tax treatment across the state.

The study finds most STRs are not operated year-round and function more like part-time or owner-occupied residences, fueling arguments that they should retain residential tax status. County assessors dispute the report’s conclusions, saying it overlooks community impacts and regulatory burdens tied to STRs.


Yates County, NY

Yates County lawmakers have voted to renew the county’s additional mortgage recording tax while opting out of a new state requirement to register short-term rentals.

The renewed tax keeps the rate at 25 cents per $100 of mortgage debt and will apply to mortgages recorded starting Dec. 1, with revenue flowing into the county’s general fund through 2027. At the same time, the county adopted a local law declining to create a state-authorized short-term rental registry.

Oneida County, NY

Short-term rental owners in Oneida County must register their properties by Jan. 1 to continue listing them on platforms like Airbnb and TripAdvisor.

The requirement stems from a New York state law passed in February 2025 that mandates a county-run registry and authorizes a 5% occupancy tax. Hosts must include a county-issued registration number in all advertisements, with registration available online at no cost. Online platforms will collect and remit the tax when applicable, or hosts must do so directly.


Berkeley, CA

Berkeley adopted Granicus’ Short-term Rentals (Host Compliance) platform to address housing shortages and rising short-term rental violations.

The city replaced a manual, staff-intensive process with automated monitoring and enforcement tools. OBerkeley reports a 95% compliance rate and more than $1.38 million in recovered STR taxes.
