Florida

Gov. Ron DeSantis signed SB 484 into law, requiring the Public Service Commission to develop tariffs ensuring hyperscale data centers bear their full cost of service without shifting expenses to residential ratepayers.

The law reinforces local governments' authority to block data center projects but also allows cities and counties to enter 12-month NDAs with tech companies, shielding proposals from public view.


Andover Township, New Jersey

Andover Township will introduce an ordinance repealing data centers as a permitted use in its Route 206 economic development zone, Mayor Tom Walsh announced May 9. The reversal follows weeks of public opposition and a physical confrontation between police and a resident at the May 7 meeting that went viral.

The township had amended zoning in September 2025 to permit data centers and increased the height limit to 65 feet in April. No formal application was ever filed. The repeal ordinance goes before a special meeting on May 12.


Chatham County, North Carolina

ECO TIP West LLC filed suit in Chatham County Superior Court to overturn the county's 12-month data center moratorium, adopted February 11. The company claims more than $11 million invested in its 750-megawatt Triangle Innovation West project on land rezoned for heavy industrial use in 2018.

ECO TIP says the county issued a zoning permit in late October 2025 confirming the data center as a use permitted by right. The lawsuit seeks expedited review, damages, and attorney's fees. The county has not yet responded.


Lysander, New York

The Lysander Town Board approved a six-month moratorium on data storage facility applications at a packed May 7 hearing. Board members announced the vote before public comment began, drawing applause from a crowd that wrapped around the building. About 15 to 20 residents spoke, nearly all in opposition. The moratorium runs through November 6, 2026.


Hillsboro, Oregon

Councilor Kipperlyn Sinclair is pushing for an emergency session to shift authority over data center tax breaks from city staff to the council. Nearly 20 new developers applied for enterprise zone abatements in the past three months, on top of 12 entities already receiving 100% property tax breaks.

After Oregon passed a statewide moratorium in March taking effect in June, more than a dozen companies rushed applications before the deadline. Sinclair wants the council to pause pending approvals.


Jonesborough, Tennessee

The Jonesborough Board of Mayor and Aldermen will hold a final reading Monday on a municipal code amendment regulating data centers and cryptocurrency mining. The ordinance requires Board approval for all data center applications and sets standards for noise, water usage, electrical demand, and annual reporting. The first reading passed March 16 and received Planning Commission approval April 21.

Cave City, Kentucky πŸ“†

Cave City's council will hold the first reading of Ordinance 26-12-3b Monday, amending zoning regulations for data centers. No project has been proposed, but the ordinance is already generating internal friction. Councilwoman Leticia Cline says a final step involving the Adjustment Board was removed at the mayor's direction, calling it the community's "safeguard." Environmental experts are scheduled for public comment.


Reno, Nevada

The Reno City Council scheduled a May 14 special meeting to consider a moratorium on data center conditional use permits, after more than a year of residents demanding standards and a prior council vote against creating protocols.

The moratorium follows a two-stage process: a 30-day pending moratorium, then a vote on a final resolution. Existing licenses, renewals, and ownership changes would not be affected.


St. Joseph County, Indiana

The St. Joseph County Council votes Tuesday on a rezoning proposal that would bring a third data center to New Carlisle. Community and faith leaders are urging a no vote, citing water supply uncertainty and electric rates that have already climbed 17% and 12% over the past year. County Commissioner Rafael Morton says AEP has assured officials residential bills will not increase. If the rezoning fails, it cannot return for six months.


Lyon Township, Michigan

Verrus, a California-based company, proposes to build its first industrial hyperscale data center near family homes and a K-5 elementary school in downtown

"No Data Center Lyon Township" is pursuing recall petitions against all seven board trustees after the planning commission approved the 1.8 million-square-foot Project Flex in September 2025 without public hearings. The 172-acre site was zoned industrial and required no variances, so the board never voted on it. The Oakland County Election Commission approved the petition language April 27.
