Pittsburg, California

The Pittsburg City Council voted unanimously to adopt a 45-day moratorium on new data center development, targeting the next two phases of the Avaio data center project at the former Delta View Golf Course.

Pittsburg City Council places 45-day moratorium on new data centers amid resident protests
Residents argue a temporary pause on the Avaio project does not go far enough as local backlash grows ahead of the election.

The pause takes effect immediately, but it does not affect the project’s first phase, which the city approved in 2024. About two dozen demonstrators protested outside City Hall, raising concerns about health risks and the project’s proximity to homes, schools, and a church. Protesters also interrupted the start of the meeting and were escorted out by police before public comment resumed. The council could consider extending the moratorium before it expires.

Davidson County, North Carolina

Davidson County commissioners vote against 4-month data center moratorium and approve new regulations

Davidson County commissioners rejected a proposed data center moratorium Monday night, instead spending most of a four-hour meeting refining rules for future developments.

Commissioners worked through a document setting standards, special uses, and the types of data centers allowed in specific areas, and approved text amendments detailing changes to those regulations. Some commissioners said the rules were overly restrictive, while others saw them as a proactive step. The new ordinance now goes to the county’s legal team for review, and any future data center application will be screened against the regulations set Monday. It’s the second time commissioners have turned down a moratorium, after rejecting a six-month pause in August.

Springfield, Missouri

Springfield City Council held public hearings Monday on extending its administrative delay on data center development to February and adding data center definitions to the city code.

Springfield City Council hears from the public on its proposed administrative delay extension and definitions of data centers
In June, the Springfield City Council passed an administrative delay on the development of data centers; that delay is up on Nov. 17.

The current delay, passed in June, expires Nov. 17. The proposed definitions would split data centers into three groups: accessory, micro, and large load. An accessory data center would have to sit inside a principal building, take up no more than 20% of its floor area, serve only the owner or tenants on site, and draw less than one megawatt. Anything at five megawatts or more, or over 10,000 square feet, would count as a large load data center, while smaller facilities would fall under the micro category. Council will vote on both measures Nov. 16.

Georgetown, Kentucky

The Georgetown City Council voted unanimously Monday to extend the city’s data center moratorium through June 30, 2027, the second extension of the pause.

In June, the Springfield City Council passed an administrative delay on the development of data centers; that delay is up on Nov. 17.

The city has also started drafting legislation that would ban hyperscale data centers citywide. Mayor Burney Jenkins acknowledged a full ban could be difficult since data centers are a legitimate business, and said the extra time will let council and planning and zoning develop restrictions as a fallback if the ban doesn’t hold. Councilwoman Karen Tingle Sames said the city doesn’t have the resources to support a data center.

Vienna Township, Ohio

Vienna Township trustees voted Monday to extend the township’s data center moratorium by 180 days and send proposed zoning regulations back for changes, over the objection of Trustee Phil Pegg.

Trustees Michael Haddle and Kim Ellis cited concerns raised by residents over the regulations’ utility funding language, including the risk of power generation costs being passed back to the township. The permitted location and electricity supply provisions were also flagged. This is the township’s third moratorium renewal, after the previous one expired Oct. 16. The revised language must go through both the zoning board and the planning commission before returning to trustees, a process Haddle estimated will take at least three to four months.

Fulton County, Indiana

The Fulton County Area Plan Commission presented a nine-page draft of Data Center Development Standards, and residents are already calling for changes.

The draft would require large or hyperscale data centers to sit at least 1,500 feet from churches, schools, hospitals, and nursing homes, and it also addresses noise, water management, energy efficiency, and financial assurances for decommissioning. Some residents said the setback should be greater, citing noise concerns. Others questioned the draft’s use of megawatts to set permit requirements, suggesting square footage would make it easier to understand how much land and farmland a facility could take up. Board members stressed the meeting was a discussion rather than a public hearing.

Ascension Parish, Louisiana

Ascension Parish Council approved a 90-day moratorium on data centers Oct. 26, with the issue set to return to the council Jan. 21, 2027.

Ascension Parish council orders 90-day moratorium on possible data centers
Council members in Ascension Parish ordered a 90-day moratorium on possible data centers as residents raised concerns about proposed projects coming to the parish.

Council Chair Chase Melancon made the motion near the end of a nearly three-and-a-half-hour meeting in Gonzales, and it passed without objection after Councilman Todd Varnado seconded it. Much of the meeting focused on high-impact development facilities such as data centers, with many residents raising concerns about the possibility of the facilities coming to the parish. Varnado said the pause gives the council more time to gather information. Parish President Clint Cointment noted the council could extend the moratorium early next year or pursue other solutions.

Kirksville, Missouri

Kirksville City Council unanimously approved amendments to its planning and zoning codes Monday to regulate future data center development, giving the city a say it previously lacked.

Kirksville City Council unanimously approves data center regulations

The new rules limit data centers to the M-2 zoning district, set size and noise restrictions, and require facilities to be at least 500 feet from residential areas. Any proposed data center would need a recommendation from the planning and zoning commission and approval of a special use permit from the city. Mayor Zac Burden said the regulations, written to comply with state law, are stringent enough to make it unlikely a data center would choose Kirksville, and any that did would have to meet standards shaped by community concerns. No data center proposals have been presented to the city.
