At A Glance 🔽

  • Georgia passed the week's most significant legislation. The state Senate passed SB 410, repealing the sales tax exemption for data center equipment and requiring data centers to cover the full cost of new generation and transmission infrastructure. The bill heads to the House before session ends in April.
  • Moratoriums continue expanding. Gibraltar, MI, Scioto Township, OH, and Zeeland Township, MI all approved a one-year moratorium. Monterey Park, CA extended its moratorium and put a ban on the June ballot. Tulsa heard a proposed 365-day moratorium.
  • Opposition is moving beyond public comment. Independence, MO opponents sued to force a referendum after the city rejected their petition. Festus, MO residents are petitioning to change the city's government structure to gain initiative and referendum powers. Monticello, MN residents gathered nearly 500 petition signatures and an environmental group sued over the review process.
  • Major projects are still advancing. Joliet's planning commission recommended approval of a $20B, 795-acre campus. Louisville approved a data center on legacy zoning. Fort Worth is rezoning 80 more acres for a 450-acre campus.
  • Regulations are tightening. New Castle County passed data center guidelines, though the effective date means current pipeline projects aren't automatically subject to them. Flagstaff reviewed an amendment with 11 operating requirements. Tucson staff are drafting strict new regulations targeting June.
  • Indiana closed its session without passing any data center legislation, leaving zoning decisions entirely to local governments even as Amazon's $11B New Carlisle facility went live.
