Clark County’s Airbnb Crackdown: Regulation or a Ban in Disguise?

Las Vegas might be the city that never sleeps, but its short-term rental scene sure has insomnia of its own. Despite thousands of listings popping up across Clark County, only 208 are actually legal—and that’s sparking major tension between homeowners, county leaders, and the Strip’s heavy hitters.

After AB363 legalized short-term rentals statewide in 2021, Clark County’s rollout has been rocky. The county imposed strict distance requirements from resorts and other rentals, capped licenses at about 3,000, and charged hefty fees nearing $1,700. Those hurdles, along with an application lottery, have left thousands of hosts shut out.

Now, STR owners have filed a federal lawsuit, arguing that the county’s rules are unconstitutional and designed to protect hotels. “Once you dig into it, it’s really a ban in disguise,” says host advocate Jackie Flores.

Commission Chair Tick Segerblom openly admits he’s “not a fan” of STRs, saying he prefers fewer than 1,200 total rentals in the county. His stance reflects the region’s deep ties to the resort industry, which raked in $9 billion last year. Protecting that revenue is priority one for local officials, who claim unregulated STRs threaten tourism jobs and housing stability.

But Airbnb isn’t holding back, accusing the county of giving “big hotels an upper hand.” They say residents are hit with “huge fines and even foreclosure threats” while facing an impossible system to comply with.

Many locals share the skepticism. Online forums buzz with complaints about noisy “party houses” and strangers overrunning quiet neighborhoods. At the same time, housing experts warn that limiting STRs too harshly could harm small property owners and dry up a much-needed income source.

As lawsuits and enforcement battles play out, the issue underscores Las Vegas’ identity crisis—can it balance its legendary tourism industry with the evolving landscape of modern hospitality? For now, it’s a high-stakes game, and nobody’s sure who’s holding the winning hand.
