Cities across the U.S. are rapidly evolving their approach to short-term rentals, responding to mounting public pressure, legal scrutiny, and safety concerns. These emerging trends reveal how communities are drawing new lines around ownership, accountability, and enforcement in the STR landscape.

⚖️ Legal Battles Are Reshaping the Regulatory Landscape: As local governments push forward with stricter short-term rental (STR) ordinances, a growing number of property owners and real estate professionals are fighting back through the courts. In Minnesota, a federal lawsuit is challenging Apple Valley and Bloomington’s ban on rentals under 30 days, alleging a violation of the Fifth Amendment's takings clause. Similar claims are surfacing in Bellingham, WA, and Lafayette, LA, where plaintiffs argue that local restrictions unfairly strip them of property rights without compensation. Meanwhile, Nantucket, MA, is delaying enforcement of a recent Land Court ruling against non-owner-occupied STRs while facing internal litigation over zoning interpretations.

🚑 Safety and Compliance Crackdowns Gain Momentum After Public Incidents: Cities are ramping up enforcement of STR regulations, often in direct response to violent events, overcrowding, or local safety concerns. Columbia, SC, enacted an emergency moratorium on new permits following a fatal Airbnb shooting, while Seaside Heights, NJ, is tightening oversight after a disorderly Memorial Day weekend yielded nearly 100 STR violations. Roswell, GA, is introducing annual inspections by the fire marshal to align short-term rentals with commercial building codes, and Bay County, FL, is overhauling its compliance systems after discovering fee collection issues.

🏠 Owner-Occupied Rentals Emerge as the Preferred Model: A growing number of cities are gravitating toward policies that allow short-term rentals only in owner-occupied or primary residences – a move designed to reduce absentee ownership, preserve neighborhood character, and protect local housing stock. Normal, IL, has approved a ban on new non-owner-occupied rentals in residential zones, with existing operators being phased out over five years. West Fargo, ND, is considering a similar rule that would limit eligibility to primary residences. Burlington, VT, and other cities are also tightening definitions of eligible STR properties to favor full-time residents.
