  • State-level action is accelerating. Oklahoma, Wisconsin, and Florida are both discussing two bills. Meanwhile, Minnesota lawmakers rallied for a two-year moratorium, and Maine introduced a moratorium bill. This, all in a single week.
  • Governors are weighing in. Illinois Gov. Pritzker called for a two-year moratorium on state data center tax incentives during his State of the State address.
  • Community opposition is blocking projects. San Marcos, TX rejected a 200-acre rezoning after a meeting that ran until 2 a.m.; Southaven, MS saw 300 residents turn out unanimously against xAI's turbine permit; Allen Park, MI collected 1,500+ petition signatures against a proposed facility.
  • Local frameworks are maturing. Linn County, IA approved a comprehensive ordinance after seven months of public input. Rice Township, PA proposed strict 1,000-foot residential buffers. New Kent County, VA previewed an 1,800-acre tech overlay district. Columbiana, AL enacted new zoning restrictions.
  • Campaign finance ties are under scrutiny. Prince William County, VA supervisors collected nearly $300,000 from data center interests in six months.
  • Referendum and procedural setbacks. Marana, AZ residents lost their bid to challenge a rezoning decision after petitions were rejected on a technicality and the 30-day filing window closed. Fulton County, IN's moratorium vote was delayed by a procedural oversight.
  • The Southeast is a new battleground. Georgia saw action in three counties (Bulloch, Athens-Clarke, and Bessemer, AL next door), while Florida's lack of hyperscale regulations drew warnings from environmental attorneys as proposals emerge across four counties.

  • Independence, MO: City council vote on tax incentives scheduled for March 2.
  • Rice Township, PA: Public hearing on proposed zoning amendments March 3 at 6:30 PM.
  • Athens-Clarke County, GA: Decision on moratorium extension and zoning code changes at the March 3 regular session. Current moratorium expires March 6.
  • Bessemer, AL: Rezoning recommendation now heads to Bessemer City Council for a final vote (date TBD).
  • Joliet, IL: Plan Commission special meeting vote on March 5.
  • Bulloch County, GA: Moratorium hearings scheduled for May 5.
