ATLANTA, GA

A limit of one primary residence plus one additional short-term rental per host is gone after Atlanta City Council voted 9-5 to strip the residency language from its March 2021 ordinance, clearing the way for enforcement to begin in January 2027. Hosts still need a city license and must follow noise and occupancy rules or face penalties and revocation.

Council member Matt Westmoreland said the nine-word cut lets the planning department fully enforce the law since a 2022 5th Circuit ruling in Hignell-Stark v. City of New Orleans found residency rules discriminate against out-of-state owners. Kelsea Bond and Liliana Bakhtiari voted no after council rejected Bond's two-unit cap.

Using forged financial documents, falsified identity details or another person's name to obtain a rental home becomes a third-degree felony on October 1, 2026 as Florida's new rental fraud law takes effect under CS/HB 1293 signed on June 12, 2026. Landlords may also end a lease obtained through fraud with a seven-day notice and no chance to cure.

Apartment industry advocates say AI is making fake pay stubs and income records harder to catch after a national survey found 93.3% of 75 owners and managers faced fraud within a year. The St. Pete Tenants Union argues felony records will deepen housing insecurity and wants public housing investment instead.


PENINSULA, OH

A prohibition on every short-term home rental except those where the owner lives on site during the stay goes before voters on November 3, 2026 after the village placed a question on banning most short-term rentals on the ballot as Issue 47. The ballot defines short-term rentals as stays of less than 30 consecutive days and the result is advisory rather than binding.

Council advanced the question 4-1 on July 14, 2026 with Councilman Daniel Krachinsky opposed over fears it could divide the community and invite legal costs while Councilwoman Jodi Padrutt said the vote would show what residents want. Council later amended Resolution 15-2026 to keep the wording neutral.


DUNES CITY, OR

New short-term rental permits would end and every existing rental would need an on-site host present during guest stays if voters approve a short-term rental initiative on November 3, 2026 that amends Chapter 123 of the city code. Existing operators would get 12 months to comply before renewal and a 60-minute window to fix violations after a complaint.

Guests could not act as the host and hosts would have to follow homeowners association covenants while the ordinance would take effect 30 days after approval and could only be changed by voters. Organizer Linda John called the effort Plan C after council inaction and cited partying, noise, traffic and trespassing.


SARANAC LAKE, NY

A temporary moratorium on new short-term rentals goes to a public hearing on September 28, 2026 after village trustees moved toward pausing new short-term rentals under Bill 168-2026 which the board passed 4-0 from its September 14, 2026 agenda.

Trustee Evans moved the resolution and Trustee White seconded it as Mayor Brunette and Trustee Ryan voted yes while Trustee Trudeau was absent. The moratorium's length and any exemptions have not been released while the village already regulates rentals through its existing local law.

JEFFERSONVILLE, IN

Special exception approval now covers new short-term rentals in more neighborhoods after the city extended its regulated zone in early September 2026 to areas off Utica Pike such as Arctic Springs, yet residents are still pushing back as investors buy homes for short-term rentals with roughly 100 Airbnbs opening downtown in a single year.

Pauletta Feldman, a 10-year resident, said the shift since 2024 has replaced neighbors with strangers while Councilman Evan Stoner said residents are demanding action. The city's November 6, 2024 ordinance requires every rental to register with a $150 one-time fee.


DUNKIRK, NY

Short-term rentals have been banned in single-family R-1 districts since July 2023 under Local Law No. 1 of 2023 yet residents reiterated objections to a Woodlands Drive rental property at a recent Town of Dunkirk board meeting. Neighbors say guests stay about a week at a time even though bookings meet the 31-day minimum that defines a long-term rental.

The town sued in Chautauqua County Supreme Court and Judge Grace Hanlon sided with the town but problems persist more than four years after neighbors first objected. Code Enforcement Officer Ryan Mourer said owner Jennifer Friedman is working the system and set a meeting with Supervisor Shari Miller and attorney Jeff Passafaro on next steps.


CARMEL, IN

A short-term rental owner the city once sued will not recover legal fees from Carmel after a judge ruled the city does not have to pay them in a decision reported on September 24, 2026. The fee fight outlasted the case itself because Carmel dropped its enforcement lawsuit in April 2026 when a new state law removed the legal footing for its rental rules.

Gov. Mike Braun signed House Enrolled Act 1210 on March 12, 2026 to ban local caps on rental properties and erase the pre-2018 exemption Carmel used to regulate short-term rentals as bed and breakfasts with the law taking effect July 1, 2026. A judge agreed in April to decide whether the city's lawsuit had been frivolous.


HAMILTON COUNTY, OH

Twenty homeowners are asking Hocking County Common Pleas Court to permanently shut down a 16-guest short-term rental in the Brad-Mer Acres subdivision after they refiled their lawsuit against Palm Side Paradise LLC on September 22, 2026. The complaint says the rental breaks covenants limiting homes to single-family residences and cites reckless driving, fires, indecent exposure and a septic failure.

Judge Jason Despetorich dismissed the original 10-plaintiff suit in April 2026 because every owner was a necessary party so the new filing names all Phase III homeowners according to attorney Dominick Brook. The Florida company bought the five-bedroom home for $945,000 in August 2024 and argues rentals count as residential use.


JIM THORPE, PA

Three short-term rental units at the historic Charles Albright Mansion at 66 Broadway were rejected when the zoning hearing board voted 5-0 to deny short-term rental approvals on September 23, 2026, turning down a special exception, a parking variance and a non-conforming use claim. Borough rules require one parking space per unit within 300 feet and the building has none.

Owner Wathohuck LLC as led by attorney Charles Laputka argued the apartments had been rented for decades but solicitor James Nanovic said rentals were not allowed anywhere in the borough before 2021. The board did grant the company's appeal of an April 21, 2026 enforcement notice and a written decision is due within 45 days.
