CONESTOGA TOWNSHIP, PA

A first-ever short-term rental zoning ordinance is now in the works in Conestoga Township after supervisors authorized the township solicitor to begin drafting one at their September 1 meeting. The vote came as operators Benuel Esh and Jordan Hostetter sought assurance they can stay open through the drafting process since zoning officer Mark Deimler had told them to cease operations pending adoption of formal rules.

Supervisor Joe DeVoy said forcing existing rentals to close was not the board's intent and promised to investigate so operators are likely to continue while the ordinance takes shape. Residents can follow the draft at the October 6 board meeting and the zoning hearing set for October 28.


MIDWAY, UT

Nightly rental zoning in Midway grew tighter last September 1, 2026 after the city council voted to shrink the Transient Rental Overlay District that governs where short-term stays are allowed. The new map drops Turnberry and Turnberry Woods together with Midway Village and Rising Ranch plus parts of Mountain Spa and a section of 100 South which means dozens of homes there lose the option to host overnight guests.

The change does not close anyone down since the three licensed rentals in the removed areas keep operating while three pending applications were turned away. Officials framed the move as protecting neighborhoods for year-round families and paired it with Ordinance 2026-26 which limits vehicles at a nightly rental to garage capacity plus two parked on a hard surface.

MARINA, CA

A long-running fight over vacation rentals may finally be nearing its end in one Monterey County city now that the Marina City Council aims to close the debate with restrictions designed to keep the city from turning into a collection of de-facto Airbnb hotels. Several homeowners have pushed back and say the changes would compromise their ability to make a living.

Under rules in place since December 2019, the city allows short-term rentals only in an owner's primary residence. Stays of 29 days or fewer count as short-term and each permit runs $950 up front with a $125 annual renewal due by June 30.

The push to curb short-term rentals in Birmingham reaches its next milestone on September 28 when the City Commission holds a public hearing on draft zoning changes that would require a minimum stay of 30 days for every rental unit in the city while exempting only the downtown overlay district and the mixed-use rail district.

Commissioners set the date on August 24 without taking further action after the Planning Board reviewed the language on August 12 while enforcement continues under the moratorium that began April 27. Building Official Jeff Zielke reported six recent rental violations along with one uncancelled VRBO reservation for the Dream Cruise that police helped resolve.


WORTHINGTON, MN

Short-term rentals surfaced as an open question when the Worthington Planning Commission reviewed a rewritten schedule of use regulations on September 1, 2026. The draft presented by Community Development Director Matt Selof and MSA consultant Claire Stickler reworks land use categories across 13 zoning districts and flags the current "Guest Home" use for clarification because staff cannot tell whether it covers a bed-and-breakfast or a short-term rental.

Staff proposed renaming the category "Bed-and-breakfast/guest lodging" while modernizing motels to "Hotel or motel". Since commissioners only offered feedback without voting, the question carries over to the October 6 meeting with no hearing date set.


CHELAN COUNTY, WA

The annual short-term rental renewal season is underway in Chelan County where owners of all registered tiers can renew their permits between September 1 and October 31, 2026 at rates that are higher than last year. Anyone who files after the October 31 deadline will owe late fees in addition to the standard renewal cost.

FOLLY BEACH, SC

A proposed class action filed September 3 in Charleston County Court of Common Pleas seeks refunds of short-term rental permit fees collected by the City of Folly Beach since 2022. Plaintiffs David Chandler and 622 East Cooper LLC argue the charge of $17.50 per $1,000 in rental income is an unauthorized tax under South Carolina law because the money flows to the general fund rather than paying for a specific service.

The filing builds on Judge Thomas J. Rode's August 14 ruling that struck down the city's 800-unit investor rental cap and the fee itself. Folly Beach has appealed that decision and City Administrator Aaron Pope declined to comment on the new lawsuit.

LEXINGTON, KY

Unhosted short-term rentals make up three of the eight zoning appeals the Lexington Board of Adjustment will hear on September 14, 2026 when TNT Kentucky Estates LLC at 3182 Aqueduct Drive along with Blama 2 LLC at 1032 Lakefront Drive and Jon Kevin Baker at 262 Albany Road ask for conditional use permits to rent out whole homes without a host on site.

Staff recommends approval for all three because each property offers adequate parking and a sound compliance record. Guest limits would be set at four for the Aqueduct Drive home and six for each of the other two ahead of the hearing in the Council Chambers and a follow-up session on October 12.


BEVERLY HILLS, CA

Deadlock defined the Beverly Hills Planning Commission's August 27, 2026 review of a request to convert up to 44 luxury residences at One Beverly Hills into nightly rentals under Aman hotel management. Cain Development wants to replace the 180-day minimum lease written into the project's 2021 approval with a one-night minimum, but the commission's 2-2 vote means the rental program moves forward without a recommendation.

Commissioner Terri Kaplan argued that centralized Aman oversight would make the rentals far easier to enforce and track than scattered independent listings. The commission was more united on a companion request, voting 4-0 to endorse 11,000 square feet of medical and surgical uses that Cain says will help generate $20 million in added annual city revenue.
